Terms & Conditions

The Comité Les Lalanne is a non-profit association governed by the French Law of 1 July 1901, established at the initiative of the heirs of Claude and François-Xavier Lalanne.

Its purpose is, inter alia, to ensure the protection, dissemination and promotion of the work of Claude and François-Xavier Lalanne; to combat forgeries and counterfeits; and to issue opinions on the authenticity of works attributed to Claude Lalanne and/or François-Xavier Lalanne.

The Comité Les Lalanne convenes regularly in order to issue opinions on works submitted for review.

Any request for the examination of a work by the Comité Les Lalanne is subject to the present Terms & Conditions.

Eligibility of the Applicant

Only the owner of the work, or their duly authorised representative, may submit a request for the examination of a work to the Comité Les Lalanne.

Application File for the Examination of a Work

The owner of the work, or their authorised representative, wishing to submit a request for examination must complete a Work Submission Form and provide the following documents :

1. A copy of the valid identity document of the owner or their representative or, where applicable, an extract from the K bis register or equivalent for companies.

2. High-definition, royalty-free, professional-quality colour documentary photographs of the work from all angles, including enlarged details and all inscriptions appearing on the work (number, signature, stamp, date, etc.).

3. High-resolution scanned copies of any certificates of authenticity.

4. High-resolution scanned copies of all provenance documentation (invoices, auction records, exhibitions, publications, ownership statements, etc.).

A flat fee of EUR 2,500 excluding VAT (i.e., EUR 3,000 including VAT) per work shall be payable once the form has been completed and approved (see Fees below).

Any incomplete or non-compliant application file will be automatically rejected.

The applicant authorises the Comité Les Lalanne to retain, reproduce, distribute and communicate to the public, in any country, by any means and on any medium, for the legal term of copyright protection, the photographs and documents supplied for any purpose, including scholarly, educational, archival, publication or exhibition purposes.

Access to the Form

Procedure for the Examination of Works

The work must be physically presented to the Comité Les Lalanne for examination.

The deposit of the work, whether by the applicant or by a fine-art transporter, shall take place strictly by appointment, against a signed deposit receipt, at the applicant’s expense, on the dates, times and at the location specified by the Comité Les Lalanne.

The Comité Les Lalanne is authorised to photograph and film the work submitted.

The applicant shall bear all associated costs and undertakes to obtain nail-to-nail insurance covering all standard risks for an amount equivalent to the value of the work during transport and throughout the period of deposit at the location designated by the Comité Les Lalanne.
An applicant who chooses not to obtain such insurance releases the Comité and its members from all liability in respect of insurance cover and waives any claim against them.

Insurance

The applicant undertakes to obtain nail-to-nail insurance covering all standard risks for an amount equivalent to the value of the work during transport and the entire period of deposit. Failure to take out such insurance constitutes a full waiver of liability on the part of the Comité and its members and a renunciation of any claim against them.

Fees

In view of the costs associated with the operation of the Comité Les Lalanne, the maintenance of the archive collection, the storage of works and their examination, a flat fee of EUR 2,500 excluding VAT (EUR 3,000 including VAT) per work shall be charged.
Payment must be made by bank transfer; all bank charges shall be borne by the applicant.

Opinion of the Comité Les Lalanne

The Comité Les Lalanne issues its opinion based on the knowledge, documentation and archives available on the date of the examination. It is under no obligation to provide reasons for its opinion.

The Comité Les Lalanne may :

  • issue an opinion that the work is an authentic work by Claude Lalanne and/or François-Xavier Lalanne;
  • issue an opinion that the work is not authentic;
  • declare that it is unable, at the time of the examination, to form an opinion regarding the attribution of the work to Claude Lalanne or François-Xavier Lalanne.

The applicant acknowledges that the Comité Les Lalanne is bound by no obligation of result and expressly waives all claims or actions of any kind against the Comité Les Lalanne or its members with respect to the opinion issued.

The opinion issued by the Comité Les Lalanne is a unique document. It must accompany the work in the event of its sale. No duplicate will be issued.

Governing Law and Disputes

These Terms & Conditions are governed by French law.
The courts of Paris (France) shall have exclusive jurisdiction over any dispute.

Privacy Policy

1.    What data do we collect and for what purpose ?

The personal data collected correspond to the information provided in the Work Examination Request Form submitted to the Comité when seeking an authenticity opinion. Their purpose is the processing of your request in connection with the opinions issued by the Comité Les Lalanne on works attributed to Claude Lalanne and/or François-Xavier Lalanne.
All requested data are necessary for the processing of your request.

Browsing our website does not require registration or the provision of personal data.

2.    What are the legal bases for processing your personal data? 

Your personal data are processed on the following legal bases :

  • Your consent, given when you submit a work for examination;
  • The performance of pre-contractual measures or of the contract, for operations relating to the management, follow-up and payment of fees associated with your request;
  • Compliance with legal or regulatory obligations, concerning data which must be retained under applicable law (accounting, requests from authorised public or judicial authorities, etc.).

3.    Who are the recipients of the personal data ?

Unless otherwise stated, the personal data collected by the Comité are intended for internal use and are not shared with third parties other than in cases provided for by law or regulation.
They may, however, be made accessible to certain service providers involved in the processing of your request.

4.    CHow long are personal data retained ?

Data are retained strictly for the period necessary for the operations for which they were collected, and in accordance with applicable regulations :

  • for the duration of the processing of your request until the opinion is issued by the Comité;
  • then for the periods required for compliance with our accounting, civil and tax obligations, in accordance with mandatory retention periods and limitation periods (e.g., up to 10 years from the end of the last financial year for accounting data; up to 5 years, plus any procedural periods, in the event of litigation).

5.   What protection measures are in place?

We implement all measures necessary to ensure the confidentiality and security of your personal data and to prevent their damage, deletion or access by unauthorised third parties.

6.    What are your rights regarding your personal data ?

You have :

  • the right of access to your personal data processed by the Comité;
  • the right to data portability, enabling you to receive your data in a structured, commonly used and machine-readable format and to transmit them to another data controller;
  • the right to rectification of inaccurate personal data;
  • the right to erasure of personal data no longer necessary for the purposes for which they were collected, or unlawfully processed, subject to our right to retain certain data to comply with legal obligations or to establish, exercise or defend legal claims;
  • the right to restriction of processing, regarding:
    – data whose accuracy you contest, for the time needed to verify it;
    – data processed unlawfully for which you request restriction rather than deletion;
    – data no longer required by the Comité for processing but still necessary for you for legal claims;
  • the right to object to processing based on the Comité’s legitimate interest, unless the Comité demonstrates compelling legitimate grounds overriding your interests, or where data are necessary for legal claims.
